The website and other services developed and/or made available by By 2 Coffee unless otherwise stated are protected by the Indian copyright laws and other applicable laws and By 2 Coffee (affiliates/ associates) is the absolute owner of all such materials irrespective of whether they are capable of protection / registration under the relevant laws.
b. By 2 Coffee is the absolute owner of all information, techniques, Know-how, software, trademarks, copyrights and materials, whether subject to statutory protection or not, made available on the Website by By 2 Coffee.

RISK OF LOSS
All items purchased through electronic mode via this website are subject to a shipment contract. This means that the risk of loss and title for such items are transferred to you upon our delivery of the items to the carrier (shipping partner) for dispatch. We take utmost care to ensure that the products are securely packaged and delivered to the carrier for safe transit. However, By 2 Coffee shall not be liable for any loss or damage incurred to the products during the transit period. We recommend that you carefully examine the package and products before accepting the delivery and report any damages to us and the carrier within 24 hours of receipt.
ORDER ACCEPTANCE
Thank you for considering By 2 Coffee for your purchase. Orders can be placed through our website at www.by2coffee.in. Please note that the acceptance of your order is subject to certain conditions, which include but are not limited to:
a. Product availability: In the event that the product you have ordered is out of stock, we will try to notify you and provide an estimated restocking date.
b. Payment authorization: We must receive payment authorization before we can accept your order.
c. Pricing and product description errors: We make every effort to ensure the accuracy of product descriptions and pricing, but errors may occur. In the event of an error, we reserve the right to cancel or refuse any order.

e. Order rejection. We reserve the right to reject any order at any time in our sole discretion.

ONLINE ORDERING AND PAYMENT
a) Order Acknowledgement: Upon placing an order on our website, you will receive an email/sms acknowledging the exact details of your order shortly thereafter.
b) Acceptance of Order: Acceptance of an order and the completion of the contract between you and By 2 Coffee.in will take place when your order is dispatched, unless you have cancelled the order in accordance with the cancellation instructions set out below.
c) Payment Authorization: When an order is placed, we request pre-authorization for the value of the order from your bank/card issuer to ensure that the funds are available. However, this remains simply a pre-authorization request until the order is shipped, at which point we actually take payment. Some card companies may show the initial request and the later charge as two separate entries, but please be assured that we only charge your card once and any ‘second’ charge is temporary and will shortly disappear. If you have any further queries, please contact your bank/card issuer.
d) SMS/WhatsApp Communication: By registering with us, you agree that we may send SMS/WhatsApp messages regarding product updates, festive offers, and marketing campaigns. Your consent is given to us for this purpose.

PAYMENT AND REFUND POLICY
1) All orders placed on our website www.by2coffee.in can be paid for only in INR (Indian Rupees).
2) We accept payments made through various modes, including Credit/Debit Cards such as MasterCard, Visa, and AMEX, Net banking, UPI Payments, and all Mobile Wallets.
3) If you use a payment card with a foreign currency denominated account to pay for an item, the amount will still be charged in INR at the conversion rate applied by the relevant payment scheme at the time of processing your order.
4) To ensure the security of your payment information, please avoid sending us any payment details via email. Please refer to our Security and Privacy policy for details of the security measures we employ.
5) We take appropriate measures to secure the personal and transactional information you provide us when placing an order. However, if the information provided by you was used fraudulently or negligently by us, we will not be liable for any losses caused as a result of unauthorized access to this information.
6) Please note that By 2 Coffee does not accept cash or cheques as payment online.
7) In the event of a payment failure, please ensure that the information passed on to the payment gateway is accurate, including account details, billing address, password (for net banking), and other relevant details. Also, check your Internet connection to ensure that it has not been disrupted during the payment process.

PRICING POLICY
1) All prices displayed on our website are in INR and are inclusive of all taxes. The taxes will be highlighted after checkout, before the final payment. We reserve the right to change prices and withdraw offers at any time without prior notice.
2) Although we take utmost care to ensure that all prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of a product that you have ordered, we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we may treat your order, in respect of the incorrectly priced item, as cancelled.
3) By 2 Coffee strives to offer the same price for all products as offered on other marketplaces where the same items are listed by us. However, if the partner brand itself lists the product at a different price, By 2 Coffee cannot be held responsible.
4) Please note that the prices of products listed on our website are subject to change without prior notice. The final price you pay for a product may differ from the price displayed on our website, depending on the availability of the product and the shipping destination.
PRODUCT AVAILABILITY / INFORMATION
1. Our website features a carefully selected range of products and services that offer an exclusive buying experience to our customers. We strive to maintain an accurate and up-to-date inventory of all products listed on our website, and we update our stock availability in real-time. However, in some cases, due to unforeseen circumstances, a product may go out of stock temporarily. In such cases, the product will be unavailable for purchase until it is restocked.

However, due to unforeseen circumstances, such as an unexpected surge in demand, some products may be temporarily out of stock. During periods of significantly increased demand and lower stock availability, such as during festivals like Rakhi, Diwali, etc., the risk of items being out of stock increases. If a product is out of stock, we will notify you as soon as possible and provide an estimated date for when the product will be available again.
4. In cases where a product is out of stock, and you need the product urgently, we recommend that you get in touch with our customer service team to explore alternative options. Our customer service team will be happy to help you find a suitable replacement product or provide you with an estimated timeline for when the product will be back in stock.
5. At By 2 Coffee, we understand that our customers expect the highest standards of quality and service from us. If, due to unforeseen circumstances, it becomes necessary to substitute an item, we will always seek your prior consent before making any substitutions. In the event of a substitution, the replacement item will be of equal or greater value than the item it is replacing. If a replacement item is of greater value, you will be liable to pay for the difference in product values.
CANCELLATION & REFUND POLICY
In case you want to cancel an order, we can be contacted at by2coffee.padukone@gmail.com or call us on (+91) 95353 68212 between 9 am to 6 pm on all 7 (seven) days of the week. We will be able to cancel the order as long as it is not shipped. Unfortunately, we won’t be in a position to cancel once the order is shipped and the same will be notified to you via email. Once the order is cancelled, we will issue a full refund for the same. The refund will be made in the same method that the payment is received, within 10 working days from the date of cancellation of order.
RETURNS & REFUNDS POLICY
By 2 Coffee values customer satisfaction and strives to provide an excellent buying experience. If there is a quality issue, the product has expired, packaging defect and hence item is damaged or a wrong product is delivered, in such a situation you may please send us an email or call on our customer care number stating the details of your concern. While sending the details, please ensure to share the following details:
1) order number
2) the item name/s,
3) picture of the product in respect of which the concern has been raised and
4) description of the problem.
Please note, any such concern is shared with us within twenty-four (24) hours from the time the order has been delivered to your address. We shall endeavor to attend to your concern and revert with our feedback on the same at our earliest. Kindly note, complaints received beyond twenty-four (24) hours of delivery, shall not be entertained.

Once we receive your return package, we will acknowledge its arrival. After receiving the package, we will inspect the product. If the issue you raised is found to be valid after the inspection, we will send a replacement to the shipping address listed in your order. Please note, we do not offer refunds; only product replacements will be provided if your concern is confirmed to be valid.
If you have not received the delivery of your order but have received an intimation by email and/or SMS that your order has been delivered, you may please send us an email or call our customer care number within twenty-four (24) hours of receiving such intimation. Your concern shall be looked into and after ascertaining the genuineness of the concern, our team shall deal with the same appropriately.

SHIPPING POLICY
The delivery will be done through our fulfilment partners who have a dedicated team of delivery personnel and a fleet of vehicles operating across the city which ensures timely and accurate delivery to our customers.
It is our endeavour to deliver the freshest tea to your doorsteps. Hence, we will ship your order within 72 hours after confirmation of your order.
Final delivery should take around 7 – 10 working days depending upon demand and courier availability.
To ensure that your order is delivered to you in a safe and secure way, we work with some of the best courier services in the country. Hence, we charge our buyers a small shipping fee to ensure the best possible services. The exact shipping fee will be added to your cart value before you make the payment.

FORCE MAJEURE
By 2 Coffee shall have no liability when there is cessation, interruption or delay in the performance of By 2 Coffee obligations due to any reasons beyond its controls including among other things breakdown of concerned servers, interruptions in communication channels, earthquakes, volcanoes or such acts of God, labour controversy, civil disturbance, economic recession, internet failures, computer equipment failures, telecommunication equipment failures, fires, floods, storms, epidemics, pandemics including Covid–19, order or domestic or foreign courts, war or the inability to obtain services from other third party service providers, transportation, or other essential commodity or service required in the conduct of its business, or any change in or the adoption of any law, regulation, judgement or decree.

ENTIRE AGREEMENT
LIMITED LIABILITY
a. By 2 Coffee does not accept responsibility for the accuracy and correctness of any content, information, data, materials, colour, description any other content made available on the website or services.
b. You expressly understand and agree that By 2 Coffee shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of property, profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from the use or the inability to use the Website.
c. To the maximum extent permitted by applicable law, By 2 Coffee shall not be held liable under these Terms and Conditions and the Privacy Policy for more than the amount paid by the User to By 2 Coffee under this Terms of Use during 6 during 6 months before the event giving rise to liability
d. By 2 Coffee accepts no liability towards any losses or damages that may be incurred by You as a result of disclosure or infringement of any of your confidential information or Intellectual Property Right by third party.
e. By 2 Coffee accepts no responsibility and bear no liability for any such publication, advertisement or promotion made on its application.
MISCELLANEOUS
If any term or clause of these Terms of Use are declared to be invalid, void or unenforceable, the rest of the agreement will remain effective. Non-exercise or delay in exercise of rights under this Terms of Use or the applicable laws shall not be construed as waiver of such rights.
